If the trial finds Mr Trump guilty, he could be barred from running for the White House again.
However, recent months have shown more Republicans stepping away from the two-thirds Senate majority that the Democrats would need to impeach Trump.
Each side of the trial will have four hours to consider the legality of the trial, it is thought by the end of the day there will be a vote or decide if the trial should continue.
If it proceeds, opening arguments from both sides will start on Wednesday and will probably continue until the weekend.
It is thought that a decision on whether or not Mr Trump will be convicted could come by next Monday.
This is the second impeachment trial for the former president, the only US president to have done so, and he has been charged with "inciting insurrection" towards his supporters who then went on to storm the US Capitol Building on the 6th of January.
Despite this, Mr Trump's legal team has said that the rioters had acted independently.
They added that the Senate trial is "unconstitutional" as Mr Trump is no longer in office, however, Democrats argue that the former president should be held accountable for his actions while he was US President.
